So, I live in a regular neighborhood with the usual HOA, nice enough houses, clean streets, and people who wave when they walk their dogs. I pay my dues on time every year and keep my place looking fine. My lawn is cut, trash can stay out of the way most of the time. Nothing crazy, but the HOA board has always had it out for me because of my truck. It is a big work truck, then some dirt from a job, a toolbox in the shed, nothing illegal and nothing hanging off the sides or anything. I park it in my garage or in the driveway when I need to unload, and sometimes the garage door stays open for a bit after I get home so I can clean stuff out or just let the heat escape. I'm a HOA member just like everyone else here, and the bylaws don't ban personal work trucks if they're not commercial vehicles parked on the street overnight or something. Mine isn't and they just hate how it looks. They call it an eyesore. They have even sent notices about aesthetics and community standards that never really stick because the rules don't actually support them. I keep every notice and my replies in a folder. My wife rolls her eyes every time another one shows up and says they are bored people with too much free time.
What they don't know is that a few miles outside of town, I own a scrapyard and storage lot. It started small years ago with towing overflow and scrap. Now, it takes impounds and temporary storage when local tow companies get backed up. A couple of the bigger tow businesses in the area use me as a backup lot when their own spots fill up. They drop vehicles, I store them, and they pick them up later, or I handle the scrap side if needed. The HOA has no idea about this because I kept that part of my life separate.
There are literally no signs at the house, no business cards left out or anything, just me coming and going in the truck, but they kept poking. One month it was the way the truck sat in the driveway, the next it was dirt on the tires tracking onto the street, always a bit vague, always friendly reminders that felt anything but. I ignored the nonsense and just documented. Neighbors who actually talked to me would shake their heads and say, "The board picks favorites." One guy down the street has a boat that sits half the year and never gets a word. My truck gets the heat though, and then it happened.
I pulled into the garage one afternoon after a long day at the lot. Door stayed up while I grabbed tools from the bed, went inside for a drink and to say hi to my wife. Came back out maybe 20 minutes later and I froze. There was a boot locked on the front wheel of my truck, right there inside my own garage. Door wide open, big yellow clamp thing, sticker with a phone number and some HOA violation code, and I just stood there staring.
They had essentially walked onto my property, into my open garage, and locked a boot on my personal vehicle that was legally parked without any sort of warning. I called the number on the sticker. It was some tow company office, and the guy on the phone said the HOA board ordered it for a parking violation and unapproved vehicle. I asked what was the exact bylaw, and he didn't know, just had the order form. I told him the truck was inside my garage on private property, and he said, "Take it up with the board."
I hung up and went inside, and my wife looked at my face and asked what was wrong, and I told her. She got mad in that quiet way she usually does. We looked at the bylaws again, even though we already knew them. Nothing allowed them to enter private property and boot a vehicle parked in a garage. Nothing said my truck was banned. They simply made it up. I could have called the cops right then and there for trespassing. I could have cut the boot or paid the fee and fought it later, but I sat there thinking.
The tow company they used was one I recognized. They sent me overflow storage all the time. My lot is listed as a backup site in the system. If they actually towed the truck, there was a good chance it would end up at my own place depending on space that day. So, I decided to wait. This is my malicious compliance with the situation. They wanted it booted and towed for this fake violation. Fine. I would let the process play out exactly as they ordered. Just essentially letting the paperwork stack up. I left the boot on, didn't even touch it, and drove my wife's car for a bit while I watched everything.
The board must have been proud of themselves. One of them walked past my house and actually smirked when he saw the truck still sitting there clamped. I waved, but he looked away, and later the tow truck showed up. Driver knocked on the door. I opened it, and he said he had orders from the HOA to remove the vehicle for the violation, and I asked if he needed anything from me. just that it was getting taken to storage. I nodded and said okay. My wife watched from the window looking like she wanted to say something, but she knew about my plan. I stood on the porch and watched them load up my truck. Door of the garage still open. They winched it up, chained it down, and drove off. I went inside and waited.
An hour later my phone rang. It was the manager from the tow company, one of the regulars I usually deal with. He said they had a truck coming in for overflow storage and wanted to confirm if I had space, and I said sure, send it over. Then I drove out to my lot, and there it was. My own truck getting rolled off the tow truck onto my own yard. The driver handed me the paperwork like normal. Vehicle description matched HOA authorization number, impound order for violation of community rules, and the owner listed as me at my home address. The whole trail was clean and stupid. I signed for the storage like I would any other vehicle, locked it into the system, assigned a spot, and charged the standard daily rate starting that day, printed a receipt and the notice that would go out.
Then I sat in my little office trailer and laughed so hard I almost cried. They had just paid through the tow company to have my truck towed to my own business so I could charge them storage on it. I didn't call anyone yet. I let it sit, and every day the storage fee added up. I took photos of the truck in my lot with the date and the paperwork, and I copied every form. The tow company sent the usual notice to the address on file, which was my house, saying the vehicle was at the storage facility and fees were accruing. I received that notice, a perfect paper trail of an illegal boot on private property, followed by a tow ordered without proper authority.
