A Cop Punched a Black Man in a Hoodie and Called Him a Thug — Then the Booking Sergeant Whispered, “That’s the Mayor”
The only way Linda knew what I did for a living in that room in that moment was that she had known before she walked in. She had picked me on purpose. Judge Alvarez turned to me. Mr. Hayes, continue.
Your honor, I have additional exhibits on ownership. You have 10 more minutes. I lifted the binder. I did not read from it.
Exhibit B, original deed for 142 Magnolia Crest, recorded the 18th of March, 2019, currently free of all liens. Exhibit C, 6 years of property tax records, all in my name, all paid timely. Exhibit D, customs entry record from Singapore Changi Airport, showing my presence outside this jurisdiction for 47 days during the period the petitioner claims she signed her lease in person at 142 Magnolia Crest. Exhibit E.
Secretary of State public record showing the notary on the petitioner's lease, had her commission revoked 14 months before the alleged signing date. I let the four exhibits sit. Counsel, Linda's attorney stood. He cleared his throat.
Your honor, we'd request a brief recess to confer with our client. Denied, he sat down. He did not look at his client. He looked at the table.
The room shifted. It is not a thing you can photograph, but if you have stood in enough courtrooms, you know the 10° drop in temperature when a piece of paper has just made another piece of paper irrelevant. Mrs. Chen exhaled. Helen Briggs put her hand on her husband's wrist.
The Channel 7 reporter wrote a single line and underlined it twice. I had cards still on the table. I did not lay them out. Judge Alvarez raised her gavel.
She did not bring it down. Counsel, do you intend to introduce additional evidence? I looked at Linda. The cardigan was perfect.
The tissue had vanished. Her hands were folded on the table in a way that was no longer rehearsed. “Your honor,” I said. “I haven't even gotten to the deed.” Linda's attorney closed his eyes.
The judge set the gavel down without ruling. We'll continue at 10:15 after a 15-minute recess. Mr. Hayes, prepare your remaining exhibits. Counsel, advise your client.
Court is in recess. She walked out. Mrs. Chen leaned forward and put her hand briefly on my shoulder. I took my phone out of my pocket and opened Maya's attachment.
I opened Maya's attachment in the hallway outside courtroom 4B with my back against the marble wall. A single PDF, 12 pages. Tennessee death certificate, August 2009. Linda May Brennan, age 22.
Motor vehicle accident outside Knoxville. Boulder County 2017 small claims docket. Lynn Bremer, Phoenix 2019 civil docket. Lynn Bernett, three driver's licenses, three names, same face.
An Oregon caregiver fraud flag from 2014 dropped when the elderly complainant died of natural causes during the investigation. The last three pages were the social security Death Master file pull. The number Linda Brennan had been carrying for 9 years, walking around Magnolia Crest with on her HOA paperwork, finding me for wreaths with that number had been issued in 1987 to a young woman who died on a state highway before her 23rd birthday. Maya's note at the bottom.
Federal identity theft of a deceased person. 18 U.S.C. § 1028 up to 15 years. I closed the file.
I walked back into courtroom 4B. Linda was at her table. She and her attorney were not speaking. He had a yellow pad in front of him and was writing nothing on it.
The bailiff called the room. Judge Alvarez returned at 10:14. Mr. Hayes, your remaining exhibits. Your honor, with the court's permission, I'd like to call three brief witnesses before introducing my final document exhibits.
Proceed. I called Diane Park, the treasurer. Three questions. Did the Magnolia Crest HOA board hold an emergency meeting in the last 72 hours?
No. Did the board vote a $50,000 fine against me for unauthorized entry? No. Did Miss Brennan have authority to invoke the emergency entry provision against my property? That clause has not been legitimately invoked in 24 years. I refused to authorize duplicate keys to the board 6 months ago when she proposed it.
Diane stepped down. The room was quiet. I called Tom Reyes. He confirmed there had been no vote.
He confirmed his name had been used by Linda on my porch the night before in front of two officers and a body camera. Without his consent or knowledge, he stepped down. I called Mrs. Chen. She took the oath in a voice that did not shake.
When Judge Alvarez asked if she had any audio recordings relevant to the matter, she opened a small leather handbag and took out a phone. I have 11, your honor. I will play one. She played the November 4th recording.
The audio was clean. You could hear the gavel down. You could hear Linda telling Mrs. Chen that another defamatory statement would result in a community conduct violation. And then, at the 11-minute mark, you could hear Linda turn to Karen Whitaker beside her and say what she thought was off mic: “The Hayes property is settled.”
The recording stopped. The Channel 7 reporter in the back row was no longer writing. She was listening with her hand over her mouth. Mrs. Chen stepped down.
As she passed me, she squeezed my arm. I went back to my table. “Your Honor, my final document exhibits.” “Proceed.”
Exhibit F. Receipt and forged HOA letterhead from Reliable Locksmith Services dated October 21st paid in cash by Linda Brennan for the unauthorized rekeying of 142 Magnolia Crest. Counsel for the locksmith has provided a full cooperation letter attached as F2. Linda's attorney's hand moved across the table to his client's wrist.
