I told him I was open to that conversation. I told him the terms would need to reflect the current situation, which included 10 years of uncompensated maintenance on my part and the legal costs the court had ordered the association to pay. I told him I was not interested in a punitive arrangement, but I was interested in a fair one, and that fair in this context meant documented, recorded, and properly valued.

The new easement agreement, Easement Agreement Number 2024-0112, was recorded with the county on a Thursday morning in February: a 20-year term, a monthly payment of $680 adjusted annually for inflation, a formal maintenance protocol, and a clause specifying that the association held no ownership interest in the land or the infrastructure, only the recorded right of use for the duration of the agreement. Patricia had drafted that clause herself, with the care of someone who did not intend to have this conversation again.

The attorney's fees came to $14,200. The HOA paid them in a single check, which arrived by certified mail in the same week the new easement was recorded.

The February morning I drove to the county recorder's office to confirm the recording, I stopped on the way back at the lower gate and walked out across the field to the tank. The ground was frozen solid, and my boots made a dry, compressed sound on the frost-hardened grass, the sound of something that has decided to hold.
