He and Chloe had been at the park for about 40 minutes, walking the path and then finding an open area of grass away from the main walkway. They had started making short videos on their phones and playing around with the kind of easy, uncomplicated energy teenagers have when they like each other and do not have anything to prove. Chloe was laughing at something Austin had done with the camera when they heard a car slow down on the road that ran along the edge of the park.
Officer Russell Dempsey had been on patrol in the area for just under an hour. When he came around the bend and his headlights caught the two teenagers in the grass, his brain made an assessment in the space of a few seconds that had nothing to do with anything either of them had done. He saw a Black teenager and a white girl, and the picture he assembled from those two observations was not a picture of two teenagers on a date. It was a picture of a problem.
He pulled his cruiser to the edge of the road, got out, and walked toward them. Austin and Chloe both turned when they heard him approaching. Austin felt the familiar tightening in his chest that came from seeing a police officer walking toward him with the kind of purpose that meant the interaction was not going to be casual. Nothing about Austin's behavior had changed when the cruiser arrived. He had not run, hidden anything, raised his voice, or tried to leave. He and Chloe were still standing in the same open patch of grass where they had been laughing moments earlier, in full view of the path, nearby families, and passing traffic. The only thing that changed was the officer's interpretation of what he was seeing.
Dempsey stopped a few feet away and looked at Austin with an expression that had already reached its conclusion. His voice came out sharp and dismissive when he spoke, directed entirely at Austin.
"What do you think you're doing? Step away from her right now."
Chloe's face changed immediately. "What's wrong, officer?"
Dempsey turned to her briefly, and his tone shifted into something that performed concern without actually containing any. "Don't worry. I'm here. I know this boy has been bothering you."
